Audio Production Booking Form Terms and Conditions

  1. The client understands that to “book” or the act of “booking” means “the making of an arrangement between client and Melody House for the supply or provision of services, an arrangement towards the provision or creation of audio products, offered by Melody House to the client subject to terms and conditions in this document.
  2. The booking arrangement hereinafter the “booking” shall be provided in the Melody House Audio Production Booking Form hereinafter the “Booking Form”.
  3. Melody House shall offer the client a list of services or products to choose from.
  4. The price of a product or service shall be provided or advised by Melody House in the Booking Form.
  5. The client shall provide clients details and their preference in the Booking Form.
  6. The client shall make payment in advance to confirm the booking.
  7. Further notes or clarifications, including the payment method shall be provided by Melody House via client’s email upon client’s submission of the Booking Form to Melody House.
  8. Production in School Project shall be on the house, subject to limited contact sessions determined by Melody House. 
  9. Bookings shall be valid 30 days from the date of submission of the Booking Form (hereinafter the “valid period”).
  10. Bookings for recording of Vocals, Recording Engineer, Performers and Studio Use shall be reserved in 1 hour time blocks. 
  11. The Date of First contact refers to the first time that the client has been given access to the services at Melody House. Subsequent contact and timings shall be determined by Melody House.
  12. Contact between client and Melody House shall take place at Information House, Room S2 or room 516 location,
  13. Preparation/ recording/ revision appointments shall be set after parties have discussed. Melody House reserves the right to reschedule an appointment.
    Unused time in a sitting may not be carried over to another session.
    If the client is unable to attend an appointed session client shall notify Melody House, by call or email, at least a day in advance.
  14. Author and performer permissions are non-exclusive.
  15. Bookings shall terminate upon expiry of  the valid period or, before such period, by parties mutual consent, or, for just cause by party in notification to the other in writing. Termination shall not affect party accrued rights. 
  16. Melody House may renew a booking on one or more similar terms and conditions herein.
  17. Delivery of a service/ product shall be made after fulfilment of all obligations.
  18. Delivery may be effected in person or by electronic means.
  19. Party has represented to the other party that no legal rights including authority, consent or property rights of any person have been infringed in the performances contemplated in the booking and further assures and undertakes to free other party from risk from any claims and/or damages connected thereto.
  20. “Studio Time/ Use” refers to refers to the period the studio or its resources are required by the client including use of the recording cubicle, microphone, rehearsal space, breaks during recording sessions and revision time.
  21. Melody House shall fulfil a service and/ or create a product in terms of its expertise.
  22. Melody House may delegate or assign a role to any member of its staff, a student or a freelancer.
  23. A service order may be renewed by permission of Melody House  subject to terms and conditions.
  24. Party email/ WhatsApp notification to other Party email/WhatsApp shall suffice in written communication.

  26. Melody House whose postal address is P.O Box 56536, 00200, Nairobi, is also trading as Music and Film Academy, located at Information House, Nairobi.
  27. The terms and conditions in this document similarly apply to Music and Film Academy and their agents.
  28. Services once sold shall not be refundable nor exchangeable.
  29. Melody House may record or photograph the client solely or together with other people during the contact sessions. 
  30. Client agrees that Melody House may use audio and images recorded during the sessions contemplated herein, and also use the client’s name or alternative artist name, in its promotions including entertainment, education, recording studio and production services in any territory in the world and for any period. 
  31. Drugs, alcohol or smoking is not permitted in the studio. Refreshment drinks or snacks may only be used in the assigned area and not near the studio equipment.
  32. Guests shal not allowed in the studio or recording area.
  33. A guest or a guardian accompanying a minor shall be allowed in the waiting area upon prior notification and identification.
  34. The Laws of Kenya shall apply in the Booking Form.
  35. Melody House may at any time update or amend the terms and conditions of the Booking Form. However, any material updates shall only apply to a new booking and not a a booking confirmed before the update.
  36. By submitting the Booking Form online the client signifies that they have issued written confirmation that they have read, understood and agreed to the Terms and Conditions of the booking.
